Moroadi Cholota’s Bail Hearing to Resume in Bloemfontein Amid Controversy

Moroadi Cholota, the former personal assistant to Ace Magashule, will return to the Bloemfontein Magistrate’s Court on Thursday morning for a crucial session in her ongoing bail application. Cholota’s attorney, Piet Tibane from Morakile Tibane Attorneys, is set to present replying affidavits to counter the State’s objections.

Cholota, aged 37, faces serious allegations including fraud, corruption, and money laundering connected to the controversial R255 million Free State asbestos project. Her legal struggle has intensified since her extradition from the United States on August 8, 2024.

In her bail application, Cholota is requesting a release on bail set at R2,500. She argues that the State’s case is insufficiently strong and points out that none of her co-accused have been held in custody thus far. Cholota was detained in April while in the US and has remained behind bars since then.

The trial, which includes 17 accused including prominent figures such as businessman Edwin Sodi and former Free State Premier Ace Magashule, is scheduled for 2025. Cholota’s legal team contends that her continued detention is unwarranted, given her intention to participate fully in the trial to clear her name.

However, the State has argued against granting bail, citing Cholota as a potential flight risk and alleging a lack of respect for the law. A lead investigator from the Hawks has sworn in an affidavit that Cholota failed to cooperate with the investigation, intensifying concerns about her release.

The National Prosecuting Authority (NPA) has criticized Cholota’s actions, stating, “Ms. Cholota has fought her extradition at every step and by every means. She has no desire to stand trial and prove her innocence.”

As the court session approaches, all eyes will be on the proceedings to see whether Cholota will secure bail or remain in custody pending the high-profile trial. The case continues to draw significant public and media attention, reflecting its high stakes and the serious nature of the charges involved.
